Criminals hear this! America is the best place on the planet for you to practice your profession and wage your war. That is the message that goes out daily from the American judicial system. With arms outstretched the judicial system says to the criminals "bring me your rapists, your murderers, your child abusers and the violent among you and our lawyers will weave a web of non-responsibility for you."
The trustee of the laws that govern crime in the USA is the American judicial system. Lawyers manipulate the system with case law, rules and technicalities and justice goes begging. Meanwhile the criminals have carried away the store! Criminals know we have a revolving door justice system and punishment is the last thing that crosses their mind!
When it comes to crime today in America, the judicial system has failed the masses. Swift and sure punishment has gone out of style. The expert psychologists and social engineers seem to have pervaded the courts with their non-responsibility doctrine- selling the judges and Juries on the idea that "the devil made me do it." Criminal lawyers (officers of the court) take on a case and immediately look for ways to get the criminal off the hook-a way to convince the court or Jury that the criminal was not responsible because of childhood abuse or some other medical disorder or deficiency. Some lawyers work vigorously to sell the idea that the criminal is really the victim and those whom the criminal has raped, maimed or killed are really the offenders such as in the Menendez Brothers murder trial in California.
Sentencing criminals is a judicial sham, a cruel lie perpetuated upon the American public. A twenty year sentence does not mean twenty years! On average in America in the past it means 7.4 years. It means turning mad-dog perverts back out on society. Some improvement has been made in this area.
Few things in our society have become more morally corrupt and destructive than the non-responsibility and denial doctrine. The master teacher for the non- responsibility doctrine in America today is the American judicial system. Lawyers (officers of the court) are the professors of this false and deceptive doctrine.
The judicial system has become a shrine for criminals to deny responsibility-to avoid choice and consequence. There is a direct correlation between crime and choice and consequence. Before the lawyers began to dream up the hundreds of ways to deny responsibility, pleas by criminals were fairly simple-it was guilty, not guilty or no contest. Today most all criminals plead not guilty for bizarre reasons that come right straight out of the cosmos!
Try this one on for size! A lawyer legislator in New Mexico in 1989 was arrested for DWI after a crash that killed an 82 year-old man. The state lawyers (prosecutors) decided not to file any charges against the lawyer after they determined the DWI did not contribute to the accident. The DWI lawyer was sentenced to 90 days in jail with 30 days suspended. The lawyer appealed to the district court. In his defense, he claimed he was the victim of a rare disease that caused his body to brew alcohol. He claimed the disease was not yet diagnosed by the medical community because it was so rare. The district judge did not buy the story in this case and the lawyer appealed to the State appeals court.
A headline from Butler, PA., tells us about a real lawyer original. Michael Ricksgers admitted he shot his wife to death. His lawyer said the defendant was the victim of a sleep disorder called Apnea. According to his lawyer, Ricksgers fired the shot in a totally unconscious state and therefore was not consciously responsible. Police who searched his home found a note in his wife's purse telling her husband she was leaving him together with a cash receipt from a divorce lawyer. Fortunately the court did not buy this story.
In Manassa, VA., another lawyer original grabbed the headlines. A rapist who tied up his victim with wire and raped her has a perfectly legal explanation. He says he met the woman in a group therapy session where they both were undergoing treatment for multiple personality disorders. The man says it was not really he that was raping but one of his multiple personalities who actually was lovemaking with one of the multiple personalities of the victim.
How about the murder trial for murder victims San Francisco Mayor George Moscone and Supervisor Harvey Milk. Defense lawyers claimed mitigating circumstances caused the defendant to murder. The lawyers claimed the sugar in the junk food diet of the shooter caused severe depression not making him accountable for his actions. The shooter served 5 years for involuntary manslaughter.
A DWI in New Mexico killed four innocent people on Christmas Eve., 1992 in New Mexico while traveling the wrong way on a freeway (story told in detail in a later chapter). Twice a hung Jury failed to convict. Why did they fail to convict? A defense lawyer put on a grammy award winning performance claiming the DWI was the victim of a severe migraine headache and his illegal level of alcohol in his body had nothing to do with the accident. A bizarre story but just enough to create a doubt for one or two jurors! The DWI was convicted in the 3rd trial but an appeal was pending.
The message to criminals from our very own judicial system is whatever you can dream you can claim! Truth and fact has nothing to do with the case. It will be a matter of how skilled the lawyer is in converting a sow's ear into a silk purse!
The media has truly discovered the drama in crime and criminal trials and their effect on ratings. Lawyers love it and the lawyer judges don't mind the high profile when it comes time for judicial retention elections. The criminal defendants become high profile if they do not have that status already. Then the movie and book offers pour in and it all becomes a media event. It is likely that somewhere from a distance in the spirit world the victims of violent crime look on in utter amazement.
Probably no case in history is a better showcase example of a media event we are describing than the O.J. Simpson case in Los Angeles, California in 1994- 95. Geraldo Herrera made a living off the case with his television shows for months. The major wire services have not enjoyed another story with such repetitive and persistent journalistic life as the O.J. Simpson drama. The story has spawned books and given the tabloids new meaning and vitality. The judge in the case Lance Ito emerged as the chief ringmaster for the media circus. Lawyer-judge Ito couldn't resist and went on television for his own interview in 1994. Prosecutor Marsha Clark entered into a $4 million dollar book deal. Prosecutor Chris Darden entered into a $1.5 million dollar book deal.
Keep in mind that the judicial system is the promoter of these media events and a message is being sent to every segment of society. Americans are most concerned about the message being sent to the criminals and the criminal fledglings of the nation. The message of course is one of glamour and high visibility for the criminal. I have a theory about the danger of that message.
My theory is that we are dealing with millions in the criminal ranks and in particular the juveniles who missed the meaning of the family unit where choice and consequence and responsibility is taught. The great government welfare program spawned millions of babies for the wrong reason and in most cases the family unit was non-existent. Generations of these individuals were devoid of a self image and self esteem outside of a family unit and they found it much easier in gangs and a life of crime. In their own weird mentality, in their life of crime and gang warfare they are paying back a civilization that denied them of the things they did not want to work for. There is only two deterrents to this mentality and that is fear and sure punishment. Both have been replaced in our society in favor of social experiments and that has become a national tragedy.
Extend this same weird mentality into the world of fame as well as fortune. Along comes media event trials for criminals and crime not only pays but could easily bring fame to a criminal with little self image or self esteem! Sociologists can play with this one for years.
While most Americans could care less and are interested only in putting criminals away in the quickest manner at the least cost, the judicial system and the media enter into a mutual joint venture to glamorize criminal trials. Born out of this joint venture is an untold number of new criminals with a mentality for glamour and they have found it!
