AMERICA
STILL THE GREATEST
NATION ON EARTH
America is a choice land above all other lands. As citizens
of this great nation we are blessed immeasurably. We are grounded in
a Constitution that gives us freedoms and privileges that
God-fearing men scripted under the guiding spirit of the Almighty-I
really believe that. If our nation remains a moral compass and
guiding beacon to the rest of the world, this nation will have a
destiny that will reach into the eternities.
But we have a heavy
responsibility. The price of freedom is not cheap. We must be ever
vigilant. Man in almost every political situation can become drunk
with power and tyranny can become his by-product. This nation is not
exempt from tyrannical forces at work in the world today.
On tyranny, from
a talk on the U.S. Constitution. "We are deaf today
to the approach of tyranny because we have lived so long under the
protection of the Constitution that we take for granted the
blessings of liberty. But the framers of the Constitution having had
bitter experience with tyranny, wrote it with the purpose to
preserve the right of local self-government-which had been the
fundamental principle on which the war of the Revolution was fought.
They were not dreamers but practical men of wide experience and they
wrote into that document the fruition of human experience in
self-government. Prospering under the privileges insured by the
Constitution this country has advanced as no other in a like period
in all history. We need more people today with strong convictions in
support of the Constitution and with courage to stand back of their
convictions. We need men with courage to refuse support to every
effort aimed at undermining the Constitution. Any change in our
social order which is really desirable can be effected under the
Constitution or by orderly Constitutional amendment rather than by
efforts to evade its provisions. We must continue to protect
ourselves against the approach of tyranny in any guise."

inroads upon the constitution by the Roman law. Now, in the
last years, we in America have gone a long distance towards the
adoption of the Roman concepts and the abuses against property
rights and human freedom and liberties which are possible under that
system. And let me say here and now that in the whole history of the
human race, from Adam until now, Tyranny has never come to live with
any people with a placard on his breast bearing his name. He always
comes in deep disguise sometimes proclaiming and endowment of
freedom, sometimes promising help to the unfortunate and
downtrodden, not by creating something for those who do not have,
but by robbing those who have. But Tyranny is always a wolf in
sheep's clothing , and he always ends by devouring the whole flock,
saving none.

American", a reprint from the Congressional record, June 11,
1940 by J. Rueben Clark, former Solicitor for the Department of
State , Under-Secretary of State and Ambassador to Mexico during his
service to the nation.
"I am an
American because I believe in a government of laws and not of men
and in a national allegiance to high principle and lofty ideal
instead of to a personal sovereign.
I am an American
because I believe in a government with three distinct separate
branches each mutually independent of the other, with no power of
delegation or appropriation of rights or powers by any one to or
from any other.
I am an American
because I believe that government must derive its "just powers
from the consent of the governed" and that branches of
government and officers shall have such powers and such only as
shall be given by the people; because I believe that the assumption
by branches of government or by officers of rights or powers not
specifically conferred upon them is usurpation; and because
impeachment or other trial lies against any officer who so usurps
rights or powers not specifically conferred.
I am an American
because I believe in the greatest possible measure of
self-government and because I believe in a federal system of
government which keeps local affairs in the hands of local
governments.

because I believe in a bill of rights which places wholly beyond the
reach of lawful government certain matters affecting "life,
liberty, and the pursuit of happiness," and specifically the
right of freedom of conscience and worship, the right of free speech
and a free press, the right to peaceably to assemble and petition
government, and the right to gain and hold property with molestation
except by due process of law.
I am an American
because under our form of government the people of the United States
have made a progress never before made by any other people in the
world in an equal time during the whole period of recorded history.
I am an American
because standards of life and of living of the entire American
people are far beyond those enjoyed by any other people in any other
part of the world, either now or at any other time, which is a
living testimony and evidence of the kindly beneficence of our free
institutions.
I am an American
because this Nation has no scheme or plan of conquest, because it
has a respect for the rights of other peoples and of other nations,
because it promotes justice and honor in the relationships of
nations, because it loves the ways of peace as against war, as shown
by the repeated peaceful adjustment of its own international
disputes, because it has conquered the land greed which so afflicts
the nations of the world, as demonstrated in Cuba and the
Philippines.
I am an American
because my country abolished slavery after it had become deep-rooted
and because men still are free to work, and are secure in the
enjoyment of the products of their labor. I am an American because I
firmly and earnestly believe that the Constitution is an inspired
document designed by our Maker to set up a government which would
make sure and secure the rights set forth in the Bill of Rights, and
particularly the right of freedom of conscience and worship.
I
am an American because I believe that the destiny of America is to
be the abiding place of liberty and free institutions and that its
own practice and enjoyment of these blessings shall be to the world
a beacon light which shall radiate its influence by peaceful means
to the uttermost parts of the world to the uplifting of all
humanity."

Every
society is a mirrored reflection of it's laws and the judicial system
that administers those laws! If that system is political, corrupt,
self-serving, anti-constitutional then equity and justice for citizens
becomes about as sure as a game of Russian roulette. Under the U.S.
Constitution and Bill Of Rights, A legal system and it's laws should
be a safety net for the innocent, a protection for law-abiding
citizens, a shelter for the abused and yes a place of retribution in
favor of those who have been victimized. When a legal system becomes
the abuser, disregarding constitutional rights and further victimizing
those victims who are seeking a safe harbor, the reflection of laws in
that society begins to turn ugly. That ugliness ripples through
society and the fallout will have far reaching consequences.
If
you accept the premise that a society is a mirrored reflection of it's
laws and the administration of those laws, America is a nation in
deep, deep trouble! The crisis reaches into every vital area of
society including but not limited to constitutional, political,
economic, financial, governmental, justice, social, moral and
spiritual.
There
are many men and women who have chosen to be a lawyer and devoted
their professional lives to equity and justice. These people are not
the target of this report. There is a greater number of the lawyer
fraternity however, who have different motives and have not been so
noble. In fact, as a general culture and class, lawyers are destroying
America, turning this nation and American justice into a financial and
political self-serving game, grinding out victims by the millions
annually.
Client
benefit, true equity and justice has been and is being subordinated to
the financial and political business opportunity concept by lawyers in
America today. Equity and justice is for sale to the highest bidder.
Because of lawyer monopoly of the legal services profession, many
Americans cannot afford to pay the ransom demanded by the lawyer
monopoly to buy a shot at justice.

159,000,000 million personal and property crimes were committed
against American citizens during a recent 13 year period, with a 26%
clearance arrest record. When that 26% was turned over to the judicial
system, the percentages go down through plea bargains, back room
political deals and God only knows what else. A sad commentary for the
American criminal justice system. Direct and indirect cost of
crime in America is now costing taxpayers a staggering $675 billion
dollars annually. America leads the world in prison population. *
America has the highest tort tax in the world that now exceeds
$1200.00 for every man, woman and child. We cannot be competitive in
the international market place. Who pays that tort tax, none other
than the American consumer.

We are the most litigious society on earth with over 95 million
lawsuits filed annually at a cost exceeding $300 billion dollars
effecting the gross national product.

Over 70% of low to middle income Americans can no longer afford the
cost of justice in America.

We have two standards of justice, the "Model T" brand and
the "Cadillac brand". Those who have money get the Cadillac
brand and those who don't have money go to prison or bankruptcy court.

Over 30 billion annually is extracted from the medical and insurance
fields by lawyers looking to extort a settlement from the deep pockets
in those professions. This drives us consumer prices for health
care.

We have laws and rules stacked end to end which would fill up the
super dome in New Orleans. Yet we have a legal mentality that looks at
a given dispute and says "If we can't find any law that has been
broken we may have to pass a new one".

We have a judicial system where politics, fraud, conspiracy,
deception, perjury, dishonesty and obstruction of justice is the order
of the day by the dominant lawyer culture who operate the system. This
translates into a giant mirror for society that if it happens in the
judicial system, you can get away with it in society. Is the judicial
system teaching immorality on the face? Nobody is responsible, nobody
is guilty, nobody is wrong, there is no real consequence for wrong
doing as long as lawyers can profit from the issue.
