Any society is a reflection of it's laws, the adjudication of those laws and the administration of those laws. That being the case, America is in trouble! America, the greatest nation on earth began with a simple legal document called the U.S. Constitution, designed to define and limit place of government and the rights of it's citizens. Even in our modern complex society that same document with a good selection of supplemental laws could still govern our nation very satisfactorily and at a cost of countless billions in savings to the taxpayers annually.
Today we have a nation that resembles a giant law factory. American lawmakers (lawyers in the majority) are grinding out new laws every day of our existence. Many of these laws are needless and are destroying America! In our research, no federal or state government agency will even dare guess how many laws and bureaucratic rules are a matter of record, governing the American people today.
We are smothered and strangled with laws that govern our every action and interaction with each other. Scores of these laws are special interest laws-harmful to most law-abiding citizens and favoring the law-breakers. An abundance of these laws serve no other purpose than to salve the egos of bureaucrats and act as a harassment tool to those who disagree with them. The majority of laws serve to further entrench the dominant lawyer culture in our society-forcing the masses to pay immoral fees to a lawyer, simply to open the doors for a marginal shot at equity and justice-which in most cases is little to none.
Not a day passes in America without a great number of our citizens being victimized by outrageous laws, needless laws, special interest laws and needless bureaucratic rules that have the same force and effect as laws. If that is not enough, consider the blatant political persecution under the guise of judicial prosecution by some of the lawyer prosecutors, which engulf the lives of many of our citizens.
Lawyers have spawned a judicial mentality gone wild and obsessed with passing new laws. That mentality looks at a given dispute and simply says, "we haven't found any law that has been broken yet...so we may have to pass one". Over the past 200 years we have permitted a dominant lawyer culture to evolve in a complete takeover of the American judicial system. The evolution of this culture has created an unconstitutional ruling class, placing the nation in a state of legal tyranny. Lawyers are the architects of our laws, they defend us in the laws, they administer the laws, they prosecute us in the laws, they judge us in the laws and they interpret the laws. Is this a constitutional conflict by all standards of constitutional law?
In the present system of lawyer dominated and self-regulated justice, litigants and the accused are powerless without lawyers and therein lies the problem. Certainly in criminal justice without defense lawyers, the lawyer (government) prosecutors would not have to justify their sometimes outrageous and perjurious conduct and the accused would be powerless at the mercy of the unlimited resources of the government.
Unfortunately the evolutionary problem in a lawyer dominated and self regulated system of justice is not the vigorous defense of client's constitutional rights. Experience teaches us that the important question is what "new low" in professional ethics will ultimately be reached in prosecution and defense in the justice system?
We have permitted our judicial system to be converted into a giant lawyer business opportunity both financial and political. The system now resembles a huge closed membership country club of lawyers, lawyer prosecutors and lawyer judges with the masses picking up the tab! Equity and justice has been subordinated to the lawyer political and financial opportunity, largely separated from an entangled legal web called the judicial system-left for the American public to cope with. Over 80% of low to middle income Americans cannot afford to pay a ransom to a lawyer to open the court house doors just to get a shot at justice.
Over 200 major legal reform groups are working for legal justice reform nationwide. Until that reform becomes a reality, individual Americans must seize the offense and learn to represent themselves in their own legal affairs, even in court. Self representation is a constitutional right. Many generic procedures can be performed without the aid of a lawyer and at a great savings of time and money. No fault divorce, bankruptcy, will preparation, revocable trust, incorporation and many more legal procedures now are sold in kit form with complete step by step instructions and even software. You simply complete the forms and file them at the court of jurisdiction.
There are hundreds of great books, manuals, audio tapes, reports and videos which assist in self help law. Take one of these products, a little courage and determination, a copy of the court rules and you can be the captain of your own legal ship. The best reason for self help law is financial. Remember when you use a lawyer you have no guarantee of winning, the only guarantee you have is that you will have to pay the lawyer. When you represent yourself you have won already financially, you don't have to pay the lawyer!
